Welcome to Run Window! These Terms of Service ("Terms") govern your use of the Run Window mobile application and website (collectively, the "Service") operated by Titan Tribute LLC ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Run Window is a weather-aware running application that provides personalized recommendations for optimal running times based on weather conditions, your preferences, and your schedule. The Service includes both free and paid subscription features.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. User Accounts

You may use certain features of the Service without creating an account. If you create an account, you are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

4. Subscriptions and Payments

Free Tier

The Service offers a free tier with limited features, including daily recommendations and basic functionality.

Pro Subscription

The Pro subscription provides additional features including the Weekend Optimizer, unlimited refreshes, extended forecasts, and calendar integration. Subscription fees are billed through the Apple App Store or Google Play Store.

Billing

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel your subscription through your device's app store settings
  • Refunds are handled according to Apple's or Google's refund policies

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Titan Tribute LLC and are protected by international copyright, trademark, and other intellectual property laws.

"Run Window" and our logo are trademarks of Titan Tribute LLC. You may not use our trademarks without our prior written consent.

7. Weather Data and Recommendations

Important Disclaimers:

  • Weather Accuracy: Weather data is provided by third-party services and may not always be accurate. We do not guarantee the accuracy, completeness, or timeliness of weather information.
  • Not Medical Advice: The Service provides general recommendations for running based on weather conditions. It is not medical advice. Consult a healthcare professional before starting any exercise program.
  • Safety: You are solely responsible for your safety while running. Always use your own judgment about weather conditions and your physical ability.
  • Recommendations: Our recommendations are suggestions only. We are not responsible for any injury, harm, or loss resulting from following our recommendations.

8. Third-Party Services

The Service integrates with third-party services including Apple Health, Google Fit, device calendars, and weather data providers. Your use of these integrations is subject to the respective third parties' terms and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TITAN TRIBUTE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any weather data or recommendations provided through the Service
  • Any unauthorized access to or alteration of your data
  • Any third-party content or services accessed through the Service

11. Indemnification

You agree to indemnify and hold harmless Titan Tribute LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Titan Tribute LLC regarding the Service.
